What is a “public performance?”

If you invite a few friends over to your home for dinner and movie and you purchase or rent a copy of any movie and show it, such an event would be considered “home use.” However, if you screen that film at your JCC, Y, church or synagogue, even if you do not charge admission, you have infringed the copyright of the movie.

The Law says. . .

The Federal Copyright Law (Title 17 of the U.S. Code) governs how copyrighted materials, such as movies, may be used. Neither the rental nor purchase of a DVD carries the right to show the DVD outside the home. There are instances where no license is required to view a DVD, such as in your home and some narrowly defined “face-to-face” classroom situations. However, activities such a “Saturday night Rabbi’s learning session at the synagogue” or “Jewish movie night at the JCC” infringe on the copyright of the movie and are in clear violation of halacha, Jewish law.

Legal Sanctions

Those infringing on copyright are subject to punishment under the law and in the case of not-for-profit institutions, members of the governing bodies are also responsible. If you have any questions on this issue, we encourage you to check with legal counsel.
